NL – COMMUNITY AGREEMENT & CODE OF CONDUCT

Dit document vormt een bindende overeenkomst met betrekking tot de gedragsnormen, vertrouwelijkheid en de bescherming van het energetische en fysieke veld binnen de SOULSTAYWAY™ Shift Tribe (hierna te noemen: “de Community”). Door deel te nemen aan de Community en het Shift-programma, verklaart de deelnemer akkoord te gaan met onderstaande voorwaarden.

Artikel 1: Doel en Veiligheid van het Veld

1.1 De Community is opgericht als een zuiver, hoogfrequent en veilig veld voor diepgaande persoonlijke transformatie, leiderschap en co-creatie.

1.2 De bescherming van de veiligheid, rust en integriteit van zowel de oprichter (Marjan Althuizen / SOULSTAYWAY™), het kernteam als alle medeleden staat te allen tijde voorop.

Artikel 2: Geheimhouding (Confidentiality)

2.1 Strikte vertrouwelijkheid: Alles wat wordt gedeeld binnen de live sessies, besloten groepen (zoals Telegram/WhatsApp), en tijdens persoonlijke of groepsbijeenkomsten is strikt vertrouwelijk.

2.2 Het is deelnemers ten strengste verboden om persoonlijke verhalen, processen, ervaringen of uitspraken van andere leden of de oprichter naar buiten te brengen, te delen met derden of op welke manier dan ook openbaar te maken buiten de besloten kaders van de Community.

Artikel 3: Integriteit, Respect en Veilig Gedrag

Deelnemers verplichten zich om te handelen vanuit nuchterheid, helderheid en respect. Het volgende gedrag is ten strengste verboden en vormt een directe schending van deze overeenkomst:

3.1 Geen grensoverschrijdend gedrag: Het uitoefenen van intimidatie, pesten, agressie, het neerhalen van anderen of het creëren van onveiligheid in de groep op welke manier dan ook.

3.2 Geen ongewenste benadering (Geen dating/seksualiteit): De Community is een professionele en transformatieve ruimte, geen datingplatform. Het is niet toegestaan om andere leden (ongevraagd) seksueel, romantisch of met datingintenties te benaderen, zowel binnen de platformen als daarbuiten naar aanleiding van het contact in de Community.

3.3 Nuchterheid: Conform de uitgangspunten van SOULSTAYWAY™ nemen deelnemers deel in een nuchtere staat, vrij van actieve verslavingen of verdovende substanties gedurende de programma-activiteiten en binnen de velden van de beweging.

Artikel 4: Bescherming van SOULSTAYWAY™ (Reputatie & IP)

4.1 Geen reputatieschade: Deelnemers onthouden zich van al het handelen—zowel online (social media, internet) als offline—dat de goede naam, de integriteit of de commerciële waarde van SOULSTAYWAY™, de oprichter of de Community kan beschadigen.

4.2 Intellectueel Eigendom: Alle materialen, methodieken, trainingen en hand-outs verstrekt vanuit SOULSTAYWAY™ blijven eigendom van SOULSTAYWAY™ en mogen niet worden gekopieerd, verspreid of commercieel worden ingezet zonder uitdrukkelijke schriftelijke toestemming.

Artikel 5: Sancties bij Overtreding & Boetebeding (Zero Tolerance)

5.1 SOULSTAYWAY™ hanteert een zero-tolerancebeleid ten aanzien van het schenden van de veiligheid, geheimhouding, integriteit of het welzijn van de groep.

5.2 Bij een constatering van een overtreding van dit contract (waaronder begrepen: het schenden van de geheimhouding, grensoverschrijdend gedrag, ongewenste dating/seksuele benadering, of handelen dat de reputatie van SOULSTAYWAY™ beschadigt) heeft de leiding (Marjan Althuizen) het recht om per direct in te grijpen. Dit resulteert in:

  • Onmiddellijke uitsluiting en beëindiging van het lidmaatschap en de toegang tot alle groepen en sessies, zonder enig recht op restitutie van reeds betaalde gelden.
  • 5.3 Boetebeding: Bij overtreding van de geheimhoudingsplicht (Artikel 2), de reputatiebescherming (Artikel 4.1) of het verbod op grensoverschrijdend/ongewenst gedrag (Artikel 3.2), verbeurt de deelnemer aan SOULSTAYWAY™ een direct opeisbare boete van € 2.500 (zegge: tweeduizend vijfhonderd euro) per overtreding, te vermeerderen met een bedrag van € 500 voor elke dag dat de overtreding voortduurt, onverminderd het recht van SOULSTAYWAY™ om volledige schadevergoeding te vorderen indien de daadwerkelijke schade hoger is.
  • 5.4 In alle gevallen van ernstige schade of juridische schendingen behoudt SOULSTAYWAY™ zich het volledige recht voor om verdere juridische stappen te ondernemen.

Akkoordverklaring

Door het verzenden van het aanmeldformulier en/of de betaling van het lidmaatschap bevestigt de deelnemer deze voorwaarden te hebben gelezen, begrepen en integraal te onderschrijven.

EN – COMMUNITY AGREEMENT & CODE OF CONDUCT

This document forms a binding agreement regarding the behavioral standards, confidentiality, and the protection of the energetic and physical field within the SOULSTAYWAY™ Shift Tribe (hereinafter referred to as: “the Community”). By participating in the Community and the Shift program, the participant agrees to the terms and conditions set forth below.

Article 1: Purpose and Safety of the Field

1.1 The Community is established as a pure, high-frequency, and safe field for deep personal transformation, leadership, and co-creation. 1.2 The protection of the safety, peace, and integrity of both the founder (Marjan Althuizen / SOULSTAYWAY™), the core team, and all fellow members takes precedence at all times.

Article 2: Confidentiality

2.1 Strict confidentiality: Everything shared within live sessions, private groups (such as Telegram/WhatsApp), and during personal or group gatherings is strictly confidential. 2.2 Participants are strictly prohibited from bringing personal stories, processes, experiences, or statements of other members or the founder to the outside world, sharing them with third parties, or making them public in any way outside the private framework of the Community.

Article 3: Integrity, Respect, and Safe Behavior

Participants commit to acting from a state of sobriety, clarity, and respect. The following behavior is strictly prohibited and constitutes a direct breach of this agreement: 3.1 No inappropriate or transgressive behavior: Engaging in intimidation, bullying, aggression, pulling others down, or creating unsafety in the group in any way whatsoever. 3.2 No unwanted approach (No dating/sexuality): The Community is a professional and transformative space, not a dating platform. It is prohibited to approach other members (unsolicited) sexually, romantically, or with dating intentions, both within the platforms and outside of them as a result of contact made within the Community. 3.3 Sobriety: In accordance with the principles of SOULSTAYWAY™, participants take part in a sober state, free from active addictions or mind-altering substances during program activities and within the fields of the movement.

Article 4: Protection of SOULSTAYWAY™ (Reputation & IP)

4.1 No reputational damage: Participants refrain from any action—both online (social media, internet) and offline—that could damage the good name, integrity, or commercial value of SOULSTAYWAY™, the founder, or the Community. 4.2 Intellectual Property: All materials, methodologies, trainings, and handouts provided by SOULSTAYWAY™ remain the property of SOULSTAYWAY™ and may not be copied, distributed, or used commercially without explicit written permission.

Article 5: Sanctions for Violations & Penalty Clause (Zero Tolerance)

5.1 SOULSTAYWAY™ maintains a zero-tolerance policy regarding the violation of safety, confidentiality, integrity, or the well-being of the group. 5.2 Upon determination of a violation of this contract (including, but not limited to: breach of confidentiality, transgressive behavior, unwanted dating/sexual approaches, or actions damaging the reputation of SOULSTAYWAY™), the leadership (Marjan Althuizen) has the right to intervene immediately. This results in:

  • Immediate exclusion and termination of the membership and access to all groups and sessions, without any right to a refund of monies already paid. 5.3 Penalty Clause: In the event of a violation of the confidentiality obligation (Article 2), the protection of reputation (Article 4.1), or the prohibition of transgressive/unwanted behavior (Article 3.2), the participant forfeits to SOULSTAYWAY™ an immediately payable penalty of €2,500 (two thousand five hundred euros) per violation, to be increased by an amount of €500 for each day that the violation continues, without prejudice to SOULSTAYWAY™’s right to claim full damages if the actual damage exceeds this amount. 5.4 In all cases of severe damage or legal infractions, SOULSTAYWAY™ reserves the full right to take further legal action.

Declaration of Agreement By submitting the registration form and/or paying the membership fee, the participant confirms that they have read, understood, and fully endorse these terms and conditions.
